These Terms & Conditions ("Terms") govern your use of the NOCTRA_OS website, platform, and services (the "Services") provided by NOCTRA_OS ("NOCTRA," "we," "us," or "our"). By accessing or using the Services, or by opting in to receive messages from us, you agree to these Terms.

## The Services
NOCTRA_OS is an AI-powered operations platform. We may update, modify, or discontinue features of the Services at our discretion.

## SMS / Text Messaging Program Terms
By providing your mobile number and opting in — verbally, through a web form, or by text — you agree to receive recurring SMS/text messages from NOCTRA_OS. The following terms apply to our messaging program:
- **Program description.** Messages may include account and service notifications, appointment or service updates, customer care responses, and other account-related communications.
- **Message frequency.** Message frequency varies based on your interactions with us.
- **Cost.** **Message and data rates may apply** according to your mobile carrier's plan. NOCTRA does not charge for the messages themselves.
- **Opt out.** Reply **STOP** to any message to unsubscribe at any time. After you send STOP, you will receive one confirmation message and no further messages unless you opt in again.
- **Help.** Reply **HELP** for assistance, or contact support@noctra-os.com or 888-599-7122.
- **Consent.** Your consent to receive messages is not a condition of purchasing any goods or services.
- **Carrier disclaimer.** Mobile carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

## Acceptable Use
You agree to use the Services only for lawful purposes and not to misuse, disrupt, or attempt to gain unauthorized access to the Services or related systems.

## Intellectual Property
The Services — including all software, content, and trademarks — are owned by NOCTRA or its licensors and are protected by law. These Terms do not grant you any ownership rights.

## Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

## Limitation of Liability
To the fullest extent permitted by law, NOCTRA will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

## Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles.

## Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
